Maintenance can be claimed by one spouse from the other in all cases except divorce by mutual consent; it is to be paid during all process of the divorce proceeding.
When the divorce is granted, the maintenance will no longer be paid.
The compensatory allowance may be established and paid to one of the spouses to compensate the difference in standard of living that will be created after the divorce.
– In the case of a legal separation, the maintenance is due for the duration of the separation.
The amount of maintenance to be paid is determined by the judge, taking into account:
- The financial resources of each of the respective spouses
- Income and expenses for each of the respective spouses
Delage-Crespin Lawyers argues over the amount requested or proposed and prepares a file that includes the documents to be considered by the judge who sets the amount of maintenance to be paid.
